GENERAL TERMS OF BUSINESS FOR ALL DELIVERIES AND PROVISION OF SERVICES OF EMBASSY THE I-OFFICE GMBH WITHIN THE SCOPE OF THE ON-LINE SHOPPING OFFER (WETTERDISCOUNT.DE).

Area of application

These general terms of business always apply to all reciprocal claims from, and in connection with a completion of contract between the customer and EMBASSY the i-office GmbH with the on-line shopping about the on-line shop "wetterdiscount.de" in its version valid at the time of the respective completion of the contract. Divergent or contrary terms of the customer who does not accept EMBASSY the i-office GmbH expressly in writing are non-binding for EMBASSY the i-office GmbH, even if EMBASSY the i-office GmbH does not contradict them expressly.

Participant

EMBASSY the i office GmbH closes contracts with customers such as,
a) unrestrictedly natural persons capable of business who are 18 years old and resident in a member state of the European Union or Switzerland;
b) legal persons that have their seat in the Federal Republic of Germany

As far as an offer of a non-participant inadvertently accepted by EMBASSY the i-office GmbH is assumed, EMBASSY the i-office GmbH within an appropriate period to the explanation of the resignation of the contract opposite the customer entitles.

Subject matter of the contract

EMBASSY the i-office GmbH delivers the goods ordered by the customers after offer acceptance. Should EMBASSY the i-office GmbH after the fact recognize that EMBASSY the i-office Ltd has committed a mistake, e.g., concerning the information of a product, a price or availabilit, must the customers immediately inform EMBASSY the i-office GmbH about the fact. This can again confirm the order under the changed conditions. Otherwise EMBASSY the i-office GmbH is entitled to cancel the contract.

Contract conclusion

For the effective conclusion of the contract a written confirmation of order (by email) of EMBASSY the i-office GmbH is needed. This can be replaced by delivery and/or invoice issuing.

Prices

The prices of the day of the order are applied. All prices are quoted including value added tax.

Delivery

Deliveries to member states of the European Union take place exclusively through dispatch by UPS or DHL as an insured parcel. In Switzerland, deliveries takes place by DHL. Deliveries are sent to the address of delivery given in the order process.

Retention of title

The ordered product remains a property of EMBASSY the i-office GmbH until entire payment completion

Guarantee

However, the customer is obliged to inform EMBASSY the i-office GmbH, at the latest, within one week after delivery of the product, evident defects of the product, as well as damages in transit.
With omission of this period of time, the term guarantee rights are excluded because of an evident defect. The defects which cannot be also identified in a careful check within this period of time are to be immediately informed to EMBASSY the i-office GmbH after identification. With justifiable reprimands of obvious defects within 2 weeks after delivery and of not evident defects within the warranty after delivery takes place a free update or substitute delivery after choice.
In case the customer is not a company, the duration of the guarantee amounts to two years after receiving of the product by the customer. If the customer is a company the guarantee term amounts to one year.
Condition for the guarantee claims is that the defect has not resulted from improper use or over-claiming. If a defect is identified only later than 6 months after delivery to the customer, the customer must keep the proof that the product.
If also the second update as well as substitute delivery goes wrong, the customer can ask for price reduction or contract rescission at his discretion. The resignation is impossible if the defect is minor and insignificant.

Cancellation right

A cancellation right of two weeks is entitled to the consumer (the natural person who closes a legal business for a purpose which can neither be added to his/her commercial ones nor to his/her independent activity after acceptance of the delivery. The contradiction must contain no grounds and EMBASSY the i-office GmbH takes place through return of the product within two weeks to the address given below EMBASSY the i-office GmbH . For the term protection the timely sending is enough.
If the buyer has made use of the product before cancellation and returns it, he/she has to perform value substitute with the pulled{drawn} use and a deterioration of the product. The value substitute can be as much as the value of the purchase price in the isolated case. If the buyer has checked the product merely in adequate form, EMBASSY the i-office GmbH has no claim to value substitute.
With exercise of the cancelation right, the consumer bears a merchandise value of 40.00 euro of return expenses. Availability reservation

Should EMBASSY the i-office GmbH find out after completion of the contract that the ordered product is not available any more with EMBASSY the i-office GmbH or cannot be delivered for legal reasons, EMBASSY the i-office GmbH can offer either one in quality and price equivalent produc, or withdraw from the contract. EMBASSY the i-office GmbH will immediately after a resignation of the contract refund already preserved payments of the customer.

Data protection

The data given with the order are stored for the winding up of the purchase under observance of the relevant data protection-juridical regulations and are processed. Third parties are made only accessible to data if this is necessary for the winding up of the bill of sale.

Payment

By a delivery cash on delivery you pay directly with the delivery by the parcel service. With prepayment you transfer the invoice amount to the account given in the confirmation of order. As soon as EMBASSY the i-office GmbH can ascertain the payment entrance, the delivery of the product takes place.
By a order with PayPal is a delivery only possible to the address for dispatch that is deposited on PayPal. A delivery to another shipping address as that is deposited on PayPal is not possible.

Others

As agreed, Berlin applies as a legal venue, provided the covenantor is a merchant.
If a determination of these general trading conditions should be ineffective or lose later their effectiveness, then thereby the validity of the remaining regulations is not affected. For this case the parties commit themselves to agree upon in place of the ineffective regulation an effective regulation those in the legal framework the economical pursued with the ineffective regulation
